  • Acquitted of All Charges DUI Acquittal

Client with a prior felony and 2 DUI convictions, currently on probation with monitored abstinence from drugs and alcohol. Case proceeds to trial in Douglas County. Despite the officers report and testimony that defendant had blood shot eyes, slurred speech, unsteady balance, staggered, and swayed while standing, the video from the officer’s body worn camera is presented by Mr. Fife. The video showed the defendant had normal eyes, no slurred speech, no stagger, and no swaying while standing. Through further cross-examination of the Deputy, Mr. Fife creates enough doubt with the jurors that the Deputy is found to not be a credible witness. Defendant was acquitted of all charges.
