The National Trial Lawyers Fife and Associates

Denver, Colorado Habitual Traffic Offender Lawyer Here to Help You

The Denver criminal defense law firm Fife Luneau, PC provides aggressive representation to clients charged with DUI and related offenses such as habitual traffic offender (HTO) violations. We understand that HTO status greatly frustrates people's efforts to get their lives back on track after an arrest or conviction. You can count on us to help you avoid or minimize the consequences of an HTO charge.

Our attorneys also assist clients who have been charged with driving under suspension (DUS) or revocation (DUR) so that they may avoid the possibility of HTO charges in the future. For truck drivers and pilots, we also have experience handling commercial license DUI cases.

Learn about HTO Status from a Denver, Colorado Repeat Traffic Offense Lawyer

In Colorado, conviction of three "qualifying offenses" within seven years time may result in habitual traffic offender status, and a mandatory five year license revocation. Qualifying offenses include but are not limited to:

  • Driving under the influence (DUI)
  • Driving while ability impaired (DWAI)
  • Driving under suspension (DUS) or revocation (DUR)
  • Reckless driving
  • Vehicular assault
  • Vehicular homicide

If a person with HTO status is found driving before license reinstatement, he or she may be charged with driving after revocation prohibited (DARP), a misdemeanor punishable by up to 18 months in jail and $5,000 in fines. The charge may be elevated to a Class 6 felony if alcohol, reckless driving, eluding law enforcement, or hit and run were allegedly involved in the incident.

Collateral Consequences of HTO Status

In addition to the criminal and civil penalties associated with HTO charges, being labeled a habitual traffic offender can have serious collateral consequences on your personal and professional life. Your criminal and driving records are readily available to insurance companies, any current or prospective employers, and even landlords. Thus, HTO status can prevent you from obtaining affordable insurance, a job, or even a place to live.

Seek Experienced, Aggressive Representation to Fight HTO Status

If you have a serious offense on your driving record and face HTO charges, or if you have been charged with a subsequent offense as a habitual traffic offender, please contact Fife Luneau, PC for a free initial consultation. Whether you need to challenge a DMV action, procure a restricted license, or avoid possible jail time, we will fight to achieve your goals.

I have known Charles L. Fife for 2 years now. Unfortunately, I required his personal expertise as an attorney earlier this year. I was very relieved when Mr. Fife agreed to take my case....
