Colorado courts handle DUI criminal sentencing while the state's Department of Revenue imposes administrative penalties, such as driver's license suspension or revocation and points for driving violations. The possible duration of a driver's license suspension depends on a person's blood alcohol content (BAC) at the time of arrest and any prior DUI or DWAI convictions:

  • DWAI - Eight points on your driving record
  • First DUI - Nine month suspension plus 12 points on your record
  • Second lifetime DUI or DWAI offense - One year revocation plus eight points for DWAI or 12 points for DUI
  • Second DUI or DWAI offense within five years - Two year revocation
  • Third lifetime DUI or DWAI offense - Two year revocation plus eight points for DWAI or 12 points for DUI
  • Three DUI or DWAI offenses within seven years - Five year license revocation as a habitual traffic offender
  • Under 21 drinking and driving with BAC of 0.02 or more but less than 0.05 - Three month suspension for first offense, six months for second offense, and one year for a third or subsequent offense plus four points on your record

After a DUI or DWAI arrest, you only have seven days to request a DMV hearing to challenge the suspension of your driving privileges. If you do not request a hearing, your driver's license will be suspended automatically, and you will lose the opportunity to contest the action.
