What Is the Difference between DUI & DWAI in Colorado?

DUI, the more serious of the two charges, refers to driving under the influence of alcohol or drugs, while DWAI means driving while ability impaired. DWAI may be charged in lieu of DUI if the arresting officer suspects a person has consumed alcohol or drugs, but does not find physical evidence of alcohol or drug use in the person's vehicle.
