Who constitutes a 'Persistent Drunk Driver':
Colorado enacted the Persistent Drunk Driver Act to deter people from driving under the influence and repeat alcohol violations. Under Colorado statutes, a persistent drunk driver includes:
- Any person who has had two or more convictions for drunk driving
- Any person who has had two or more license revocations for drunk driving
- Any person who continues to drive after an alcohol-related license suspension
- Any person who drives with a BAC level of .170 or greater
Additional DUI Penalties for Persistent Drunk Drivers:
Without experienced defense counsel, individuals convicted for drunk driving and labeled as a persistent drunk driver may face additional penalties for drunk driving:
- Additional fines up to $500 more than first offense DUI fines
- Mandatory 5-year license revocation (3 DUI convictions in 7 years)
- Other applicable criminal penalties and collateral consequences
- Any driver found to have a BAC above .170 will also need to have an interlock ignition system in their car for two years after any period of revocation.
