As a licensed driver in Colorado, you automatically provide consent to a chemical test if you are lawfully arrested for driving under the influence. This is known as the state’s “express consent” law.

That means if you refuse a post-arrest breath test, you will lose your driver’s license for one year. If you refuse a second time, you lose your license for two years. For your third or any subsequent refusal, it results in a three-year license suspension.

On the other hand, when a person is pulled over for a traffic violation or suspected of DUI, a police officer may ask him/her to take a roadside preliminary breath test (PBT). If you at least 21 years of age, you may decline this type of breath test without facing legal consequences.
