There is one piece of good news for parents of a minor charged with illegal consumption or possession of alcohol. Colorado Defense Attorney Representing Truck Drivers & Pilots Charged with CDL DUI
Charles L. Fife & Associates, PC provides aggressive defense representation to truck drivers and pilots accused of operating a vehicle while intoxicated or impaired by alcohol or drugs. When called upon to defend professional truck drivers and pilots, we never forget that a DUI conviction can result in the loss of a person's livelihood.
Penalties for Commercial License DUI in Colorado
In Colorado, rules regulating commercial driver's licenses (CDLs) are significantly more stringent than those regulating ordinary driver's licenses. The legal limit for a person operating a commercial motor vehicle is 0.04 rather than 0.08, and even a relatively minor traffic violation can lead to a CDL suspension. If convicted of DUI, you may lose your license for one to three years. After a second offense, your CDL may be suspended for life.
If a CDL is revoked, or if it is suspended for more than one year, the driver must be retested, but suspensions less than one year are automatically reinstated. Our Denver CDL DUI defense attorneys can help you fight DUI charges, so that you may keep your commercial driver's license or minimize a license suspension. Our goal is to get you back on the road as soon as possible.
Defending against DUID Charges
Truck drivers are often required, or given incentives, to meet seemingly impossible delivery deadlines, causing them to turn to over-the-counter and prescription stimulants to stay awake for long periods of time. If stopped by law enforcement, a truck driver using a stimulant may be charged with driving under the influence of drugs (DUID), even if he or she has only used legal substances. We have helped many commercial drivers fight DUID charges, understanding that in many of these situations the drivers were simply trying to meet the demands of their jobs.
DUI Defense for Denver Pilots
If you have a Denver pilot license and DUI arrest, you are subject to Federal Aviation Regulations. For example, if a pilot has had two or more alcohol-related motor vehicle convictions or state motor vehicle administrative actions within a three year period, the Federal Aviation Administration (FAA) may deny an application for, suspend, or revoke an airman certificate or rating. A pilot convicted of any alcohol or drug-related motor vehicle offense must report the incident to the FAA or risk other penalties. In the course of fighting DUI charges, we have helped many pilots comply with federal regulations after a drunk driving arrest.
