Charles L. Fife & Associates, PC proudly represents clients charged with criminal offenses in Colorado state and federal courts. We concentrate a substantial portion of our practice on DUI and DWAI defense, and have handled more than 2,500 DUI cases. Confident in our knowledge of law and procedure, we take an aggressive approach to protecting our clients' rights, never hesitating to fight for the best result for each client.
What Is the Difference between DUI & DWAI in Colorado?
DUI, the more serious of the two charges, refers to driving under the influence of alcohol or drugs, while DWAI means driving while ability impaired. DWAI may be charged in lieu of DUI if the arresting officer suspects a person has consumed alcohol or drugs, but does not find physical evidence of alcohol or drug use in the person's vehicle. A Denver, Colorado DWAI lawyer at our firm can further explain circumstances in which law enforcement can make an arrest on mere suspicion.
In most situations, a breathalyzer test or a blood test determines the type of charges filed in a DUI or DWAI case. If a breath or blood test shows a blood alcohol content (BAC) of more than 0.05 but less than 0.08, a person is presumed to be driving while impaired (DWAI). DUI charges will likely be filed if a person tests at or above 0.08, the legal limit in Colorado. A person may be classified as a persistent drunk driver and subject to especially severe penalties, such as additional fines and a five year license revocation, if a test shows a BAC level of 0.17 or greater. For more information about DUI and DWAI penalties, please see our DUI sentencing page.
Our lawyers are also experienced Colorado DUID attorneys, and can help you if you have been charged with driving under the influence of drugs, including marijuana, prescription drugs, methamphetamine (meth), and cocaine.
How Can a Denver DUI lawyer Help in My Case?
If you go to court on your own or if you simply accept your fate and plead guilty to the charges, you face jail time, driver's license suspension, large fines, mandatory public service, and probation, and that is just for a first offense. A DUI conviction can also affect you long after you have fulfilled your punishment, making it difficult to procure employment and promotions, school loans, and professional licenses. An experienced drunk driving defense attorney can help you avoid the serious consequences of a DUI or DWAI conviction.
