Colorado Lawyers Questioning the Results of Breathalyzer Testing
Breathalyzer testing is not a simple process. Accurate readings depend on highly trained test administrators and properly calibrated breath testing equipment. The potential for error is high, often leading to unwarranted DUI charges.
If you have been charged with a DUI in the Denver area, contacting an experienced criminal defense attorney is critical to protecting your rights and freedom.
At Charles L. Fife & Associates, PC, we offer aggressive defense to those charged with DUI, often challenging the accuracy of breathalyzer tests in an effort to have the charges against you dismissed or reduced. The Preliminary Breath Test
During your initial stop for suspicion of DUI, the law enforcement officer may have included a preliminary breath test (PBT) as part of the field sobriety testing process. The PBT, usually performed by an instrument called the Alco-Sensor, gives an unscientific reading of your blood alcohol content (BAC). Field officers tend to use it as the final piece of evidence that you were, indeed, driving under the influence.
The Breathalyzer Test
The actual breathalyzer test is not given until you have been brought into the police station. These tests are not infallible. They are susceptible to both mechanical and human error. Inaccurate results could lead to being charged with a much more serious offense than merited.
Challenging the Results
If you were arrested for DUI based on breathalyzer test evidence, you may have a strong chance of having the charges against you dismissed. Our firm fully understands not only the laws surrounding DUI but also the science associated with breath testing. We question the validity of the test by asking:
- Was the officer certified to perform a breathalyzer test? Did he or she have a current operating certification?
- Was the machine calibrated properly? Did it receive adequate maintenance and inspection?
- Did procedural errors conducted during a field sobriety test invalidate the result of your PBT or breathalyzer test?
