Attorney Luneau Helps Client Get Plea Deal in DUI Crash Case

Attorney Danny Luneau recently helped our client obtain a plea agreement in a DUI accident case in Longmont that resulted in another driver’s injury. The 23-year-old woman was sentenced to probation for up to two years and community service for up to 48 hours after pleading guilty on November 8, 2019, to one DWAI count and one careless driving resulting in injury count.

As part of the agreement, the prosecution dropped the original charges of driving under the influence and vehicular manslaughter. Furthermore, our client doesn’t owe any restitution to the other driver, who was not charged with any crimes.

A first-time DUI in Colorado is punishable by a maximum one-year jail sentence, a fine of up to $1,000, driver’s license suspension for up to nine months, and community service for up to 96 hours. Vehicular manslaughter is a class 4 felony that carries a prison term of up to six years and a maximum $500,000 fine.

Although initial reports suggested our client caused the car accident and injury, Attorney Luneau said a crash reconstruction proved the other driver involved in the collision was driving in the wrong direction and subsequently caused the crash. Additionally, he also said there was evidence that the other motorist was under the influence at the time of the accident.

Although our client received a favorable plea deal, she also acknowledged the dangerous mistake she made. In addition, she has gone to alcohol treatment and therapy and done nearly 30 hours of community service prior to receiving the sentence in court.

“She knows there is no excuse even though she wasn’t the proximate cause of what happened,” Attorney Luneau said to the Longmont Daily Times-Call. “She was drinking, she was intoxicated, she was weaving, and she knows she could have killed somebody.”
